How can we prove mistrial in my dad's case?

Answered by attorney Lawrence Lewis (Unclaimed Profile)
Criminal Law lawyer at Lawrence Lewis, P.C.
Your adult father made a confession outside of your mother's presence, so you think that it was not voluntary. The statement was recorded. So, ask the attorney for a copy of the full confession and you will see the justice in all of it. There is no mistrial. The other option is to now pay an attorney to appeal the conviction.

Deposition request

Answered by attorney Warren S. Hecht

You can contact the court in which your case was dismissed. You can obtain a certificate of disposition. I believe the fee is $10. Maybe they will left you mail it in if you tell them that you are out of town.

How long does a da have til they have to file an inditement against you

Scott Glen Cerbin
Answered by attorney Scott Glen Cerbin (Unclaimed Profile)
Criminal Law lawyer at Scott G. Cerbin, Esq., PLLC
The general rule is 6 months - however, this is not really accurate.  While the DA will often dismiss a a case if they do not have an indictment within 6 months - they dont have to.  If there is no action after one year a motion can be made under CPL 180.85 in the criminal court; which otherwise has no jurisdiction over a felony complaint.
