Will i be facing jail time for a false report of felony?

Answered by attorney J. Allen Fiorletta
Criminal Law lawyer at The Fiorletta Law Group, PLLC
Yes, there is the possibility of receiving jail time upon conviction for this offense. Courts do not tend to look favorably on those who commit this offense since it undermines the entire criminal justice system. Your previous record, and what you are ultimately convicted of (if anything), will impact the sentence. You need an attorney to assist you with resolving this case.

Will I be able to get my record expunged or sealed?

Answered by attorney Loren M. Dickstein
Criminal Law lawyer at Lewis Dickstein P.L.L.C.
No, you are not eligible for an expungement. There is a chance that a 6.500 Motion (Motion for Relief from Judgement) could be filed on your behalf. The motion is highly complex and you will probably need to work with an attorney to see if that is a viable option for you.

What possible repercussions do I face from shoplifting?

default-avatar
Answered by attorney Francis John Cowhig (Unclaimed Profile)
Criminal Law lawyer at Francis John Cowhig
It sounds like the fine that the LP told you about is what is known as a "Civil Demand". As a rule, I advise clients to ignore these civil demand letters. Unless you signed some agreement to pay this store, you owe them nothing. In order for you to owe them something they would have to sue you and win. However, It would cost them much more to sue you than they can ever hope to recover so they usually don't pursue it. With that in mind, I would advise that they can still take legal action against you by filing suit in small claims court. If you ignore these actions, a default judgment will be entered against you. So, although you can ignore the civil demand letter, do not ignore anything that comes from a court. Also, payment of the civil demand does not guarantee that the store will not press criminal charges against you.
