Can a misdeamor be changed to a felony?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
I'm not sure exactly what you mean by "changed" into a felony. The prosecutor can always increase the charges if they believe the facts in the report or testimony on the record indicates such.

Am I criminally liable for the fraud committed by another person?

Answered by attorney Dennis Julian Roberts (Unclaimed Profile)

If they can't establish that you KNEW the stuff he bought for you was on a hot credit card they cannot prosecute you SUCCESSFULLY - but they may well try. You need a lawyer to deal with this. Meanwhile, DO NOT speak with the cops. Get a lawyer and let him/her deal with the cops.

How do you go about filing a restraning order on someone and what do you need to do it

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
The answer depends on weather you have a family law case or not. If part of a divorce, it is filed in the court weer the divorce is pending. If not, there are several possibilities. If part of a business relationship problem it is filed in a county or district court depending on the nature of the problem. I would suggest a consultation with a lawyer to see where the filing should be made. The answer depends on many things that are not in your question.
