Assuming you are under 21 years of age (if over, then poss MJ not illegal), you have the affirmative defense to poss of MJ as soon as a doctor makes the written recommendation that you send to the MMR to get the red card. You might be charged even if you show a copy of the doc note to the cop, but the case will likely be dismissed. If not, you have a solid case to try.

No you can not sue the prosecutor, absent certain circumstances he has no obligation to remove the conviction in addition  the Prosecutor is the highest elected official in his office, MCL 691.1407 provides; (1) Except as otherwise provided in this act, a governmental agency is immune from tort liability if the governmental agency is engaged in the exercise or discharge of a governmental function. Except as otherwise provided in this act, this act does not modify or restrict the immunity of the state from tort liability as it existed before July 1, 1965, which immunity is affirmed. (5) A judge, a legislator, and the elective or highest appointive executive official of all levels of government are immune from tort liability for injuries to persons or damages to property if he or she is acting within the scope of his or her judicial, legislative, or executive authority. Thus he has absolute immunity. If however, the juvenile conviction was the result of a plea agreement, which stated the conviction would be expunged when you turned 18, the proper remedy is a Motion to the juvenile court or a Petition for Writ of Mandamus to the circuit court.
