What expense numbers do I need to file for a chapter 13 bankruptcy?

default-avatar
Answered by attorney Glenn Roethler (Unclaimed Profile)
Bankruptcy lawyer at Greeves & Roethler, PLC
That's a complex question. I believe you should speak with an attorney regarding that question. It really depends on which trustee you are preparing for, and which expenses you are talking about. Some are national standards, some are state, and some are actual expenses. I can't answer your question more precisely because I don't know what expenses you are speaking about. That is a rather long form. Finally, if you are filing chapter 13, most attorneys can arrange it so that you are paying very little up front, and that their attorney's fees are being paid in the plan, which actually means that your creditors are the ones to take the monetary hit, rather than yourself.

How do you know if you should file for bankruptcy?

default-avatar
Answered by attorney Roger J Bus (Unclaimed Profile)
Bankruptcy lawyer at Debt Relief Law Center
You can file bankruptcy with any amount of debt. It can affect your credit for up to 10 years, but many credit unions and car lenders will finance you much quicker than that. FHA, VA, HUD house loans, for example, generally ignore bankruptcies after 2 years.

What happens with student loans after bankruptcy is discharged?

default-avatar
Answered by attorney Austin M Hirschhorn (Unclaimed Profile)
Bankruptcy lawyer at Austin Hirschhorn, P.C.
If the co-signer on your student loans filed bankruptcy and received a discharge of their responsibility on the debt this would not change your obligation to pay the student loans. You should contact the lender and make arrangements to pay the balance that is owed. If you work this out with the creditor you should request that they contact the credit reporting agencies and clear up the negative information on your credit report.
