Can I take withdrawal from 401k after I file Chapter 11? How?

Keith Austin Wellman
Answered by attorney Keith Austin Wellman (Unclaimed Profile)
Bankruptcy lawyer at Wellman Law LLC
I find it unlikely that a person would be representing themselves in Chapter 11 and often hear debtors refer to Chapter 11 when they mean 7 or 13. Under either 7 or 13 I would expect the Trustee assigned to your case to be helpful with this question and the answer could depend on other factors such as your jurisdiction, how much you want to take out and the purpose for withdrawal.

I filed for bankruptcy but am still haing financial problems, what can I do?

Maureen O'Malley

You can give up the house without penalty if you choose. Stay there but don't pay the mortgage. They'll eventually foreclose (may take a year or more) and you'll have to leave once it sells. But you'll owe nothing more. You'll have to pay HOA dues if you have them, and keep it insured. You may also have to pay property taxes unless those become due bt the foreclosure buyer. As to your truck, you'll have to keep it up to date if you want to keep it. You may find a friend or relative willing to give away or sell something cheap to keep you going until you're back on your feet.

Is it legal for debt collection/reposessor to call your mother and tell her you are a rapist to trace calls?

Absolutely not. The problem is going after that type of individual or company. Even in the debt collection world, that type of comment is so outrageous that it is coming from a criminal that bought debt and is trying to collect by any means possible. You could find a fair debt collections practices attorney to go after that company, but it is more likely than not someone that can't be caught.
