I'm divorced, and want to know if I can file bankruptcy and include the house.

Katie Marguerite Miller
Answered by attorney Katie Marguerite Miller (Unclaimed Profile)
Bankruptcy lawyer at Law Offices of Katie M. Stone, P.A.
Yes, if you file a bankruptcy you must list that you have the house and owe on the loan.  If you do not reaffirm the loan in your bankruptcy, your legal obligation to pay the mortgage will be discharged and you will no longer be responsible for the loan.  This does not take care of the title (or deed) to the house.  New Jersey is a lien theory state meaning that when you take out a mortgage, the lender gives you the title to the house and places a lien for the amount of the mortgage on the house.  Foreclosure is the way the lender takes back the title to the house.  Although the bankruptcy takes care of your legal obligation to pay the mortgage, the house will still have to go through foreclosure before the bank takes the title back.  I hope you found this answer useful.

What happens if I get married after filing chapter 13?

Your plan still needs confirmation. Your household income needs to be disclosed. Therefore, the marriage may change your budget.

What state do I need to get my attorney from?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
This is a question reqarding venue and where one can file a bankruptcy case. You can file bankruptcy in the district where you have either resided or had your principal assets located in the greater part of the 180 days prior to filing the case than you or your assets have been located in any other jurisdiction during that period.  This usually translates to 91 days.   Thus, if you have lived in New Jersey and had your principal assets there for the last 91 days, that is where your case would be filed. Where your debts were incurred is completely and utterly irrelevant. Mark Markus has been practicing exclusively bankruptcy law in California since 1991.  He is a Certified Specialist in Bankruptcy Law by the State Bar of California Board of Legal Specialization,  AV-Rated by martindale.com, and A+ rated by the Better Business Bureau.
