How many times can u file for bankcruptcy

Answered by attorney Joseph M. Rosenthal
Bankruptcy lawyer at Rosenthal & Mintz, LLP
If it is a Chapter 7, you can file every seven years.  There is no limit as to how many times one may file a Chapter 13 or Chapter 11, but reasonable limits may be imposed by the Court if an interested creditor objects and bring the matter before the Court for abuse of the Bankruptcy Code.

Can I file bankruptcy if I am on disability because I can't pay my loan payments?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
Someone can file bankruptcy while on disability but whether you should file bankruptcy is another question altogether. Many people who only have social security as their income do not need to file bankruptcy because if they do not pay their loans, there may be little or nothing their creditors can actually do to collect from them. Of course, if you do not pay your vehicle loan, expect the repo man to come out and pick up the vehicle in the middle of the night.

If my former wife does a quit claim, does that remove her from paying the loan?

Answered by attorney Sharon M. Siegel
Bankruptcy lawyer at Siegel & Siegel, P.C.
Absolutely not! This also has many negative implications. If you have mortgage problems, speak to a lawyer to deal with them properly.
