You can do a motion to modify plan but I HIGHLY recommend you pay someone to take a look at your case and give their second opinion. There is a BIG difference between the quality of lawyers out there.

What can I do about debt in our divorce?

Answered by attorney Anne Barbara Howard (Unclaimed Profile)

If you both signed the contract with WF, they can hold both of you responsible, regardless of what your divorce says. However, your divorce document may say that your ex can come after you if she is held responsible for the debt. Check the document.

If I am in the process of filing chapter 7, do I continue to pay on my mortgage in the meantime?

Answered by attorney Marjorie A. Guymon
Bankruptcy lawyer at Goldsmith & Guymon, P.C.
If you do not want to keep your home you do not need to keep paying on the mortgage. However, if you want to keep it through the bankruptcy then you must continue to pay or work out a loan modification with your lender.
