Can I refinance while in chapter 13?

Daniel J. Winter
Answered by attorney Daniel J. Winter (Unclaimed Profile)
Bankruptcy lawyer at Law Offices of Daniel J. Winter
You may be able to refinance while in your current Chapter 13. You have to consult with your attorney, and provide the refinance application. Then he or she will have to petition the court for permission to do it. Depending on the terms of your refinance, your Chapter 13 plan may have to change also. It is important that you talk to your attorney, and if you don't have one, you should contact an attorney experienced in Chapter 13 bankruptcy.

Are we still liable for the debt if they did not allow us to re-affirm the mortgage?

Diane L Drain
Answered by attorney Diane L Drain (Unclaimed Profile)
Bankruptcy lawyer at Law Office of D. L. Drain, P.A.
The creditor cannot sue you on the secured mortgage debt so long as the debt was listed in your bankruptcy and you did not reaffirm the debt. The lender has a lien on the house and they can foreclose. Remember you still own the house until it is foreclosed or you transfer title.

At what point can a bankruptcy attorney remove a lien on a house or garnishment on a paycheck?

Answered by attorney Rex K. Daines
Bankruptcy lawyer at OlsenDaines
IF they obtained a judgment, they already have a lien on the home. The lien happens automatically when the judgment is entered. Also, they can garnish wages the moment the judge signs the judgment. You can file a bankruptcy anytime and the garnishment stops the moment the bankruptcy is filed. In most cases, you can eliminate their judgment lien through the bankruptcy, but there is additional work that a bankruptcy will need to do (which means some additional cost to you).
