Can the trustee take 100% of the proceeds if the business owner wins the tax lawsuit?

Answered by attorney Mark E. Bredow (Unclaimed Profile)
Bankruptcy lawyer at Bredow Law PLC
More information is required. You do not mention which entity filed the bankruptcy, the owner, or the business. If the owner filed a personal bankruptcy, then his interest in the LLC is limited to the value of his ownership shares. If the LLC filed the bankruptcy, then the Trustee would control the business and would be responsible for filing any tax returns and payment of any corporate taxes. The shareholder should be discussing these issues with the Trustee to ensure the taxes are paid, and if necessary, bring the issue before the Court to ensure that the proceeds pay the expenses.

What should we do to stop a foreclosure sale after bankruptcy?

Maureen O'Malley
Answered by attorney Maureen O'Malley (Unclaimed Profile)
Bankruptcy lawyer at Maureen O'Malley
There are a lot of questions I have. How late is the mortgage? Was the mortgage listed in the bankruptcy? What was said about intentions concerning the house? If the property is tenants by entirety the creditor should not be able to foreclose as against one. Please see your bankruptcy attorney to clarify this. It's too important to handle alone or to decide on a course of action based on an email.

Where would I list a court fine, and a judgement on a Chapter 7 Bankruptcy Petition?

Answered by attorney Raymond Hillel Aver (Unclaimed Profile)

It depends. If the court fine and the judgment are unsecured, they should be listed in Schedule F. However, if either is secured by any personal or real property, the secured debt should be listed in Schedule D. The reason for listing the account number(s) is to assist the creditor(s) in identifying the account debtor. All the account numbers should therefore be listed.
