We are being sued from a credit card company that was suppose to be handled by ClearOne Advantage how should I proceed?

It is rarely advantageous for consumers to use for-profit debt settlement companies. There are many complaints that they took money from consumers, applied it to fees, and did not settle the debts. Try non-profit consumer credit counseling services instead. You should revoke the power of attorney and appear and defend the lawsuit. Make certain you comply with all deadlines. Generally, if the lawsuit is brought by a debt buyer, they cannot prove anything (including their ownership of the debt, the amount, etc.) and you should resist the lawsuit. If it is an original creditor likely to be able to produce a witness (e.g., a bank with local offices) you should try to settle.

You can file another Chapter 13, but it will be several more years before you are eligible to receive another discharge, so don't look to file Chapter 7 any time soon.
