What are my options if I'm being sued by an out-of-state debtor for violation of automatic stay?

Answered by attorney William Monroe Rubendall (Unclaimed Profile)
Bankruptcy lawyer at William Rubendall Attorney at Law
An automatic deduction by a debtor is considered a voluntary payment rather than a collection effort. If the debtor asks to stop the payment failure to do so would be a violation of the automatic stay.

Can we hold a wife responsible for a judgment if husband filed bankruptcy?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
Not sure what you mean by holding the wife responsible.  According to your fact you obtained a judgment against her, so she is "responsible" for the debt. However, the community discharge of 11 U.S.C. 524 prevents collection against any community property assets.  You are free to collect against any separate property assets the wife may have, but not community property.

I filed for Chapter 7 and surrendered my motorcycles but they did not sell so they were returned to me, what should I do now?

In Ohio, there is no mechanism to remove a motor vehicle lien that the lender has written off. So, in theory, you can't even junk a worthless car, truck, boat or motorcycle with a lien on it. I would recommend that you send a certified letter to the lender saying that if they don't pick up the bikes within 21 days you are going to abandon them. After the 21 days, call the charities that advertise they take "no title' junk vehicles and arrange from them to be towed away. You do not want to leave them on public or private property because then you'd be subject to fines and storage costs because you're still listed as the owner.
