Do I need to provide all these information about my car and insurance that are both in my name only if my husband is filing chapter 7?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
Even though you are not filing bankruptcy, because you and your husband are a household, your income and your expenses matter in determining whether or not your spouse is entitled to the many benefits of bankruptcy. This falls into an area known as good faith. If your spouse could afford to pay all or part of his debts, he would not be eligible to obtain these benefits. It is not unreasonable for the court to ask for documents about your finances to substantiate his claims of financial hardship.

If I file a chapter 13 bankruptcy can the credit card company sue me?

default-avatar
Answered by attorney Kevin W. Bruning (Unclaimed Profile)
Bankruptcy lawyer at Bruning & Associates, P.C.
If you file for bankruptcy, something goes into effect called the "automatic stay." The automatic stay requires all of your creditors (i.e. credit card companies, mortgage companies, etc) to stop making any efforts to collect from you. This includes any lawsuits they have filed or are planning to file. Make sure you include the creditor on your bankruptcy petition and that notice is sent to them and to the attorneys handling their lawsuit against you. Many other factors go into whether or not the automatic stay applies or if a debt can be discharged in bankruptcy, so please consult a bankruptcy attorney about your particular case.

Do I receive money from my deceased father's life insurance if I am the beneficiary but am only 20 years old?

Answered by attorney Richard A. Heller
Bankruptcy lawyer at Richard A. Heller, P.A.
This response assumes that you are not in bankruptcy, and that we are talking about an estate in Florida.  Your age is not an issue regarding an entitlement due to your being a beneficiary of a life insurance policy.  Please explain why you believe there is an issue.  Ordinarily, this is not a problem.  Proof of the person's passing, a form to fill out, and proof of who you are, is usually all that is needed. If you are stating that you are the beneficiary through inheritance, then that is a whole different issue, and I would need much more information to respond.  in that case, you should speak to a probate attorney to determine your rights or entitlement.
