In New Jersey, it would depend on whether or not the order says that there is a bar on filing or not. Also if you decide to re-file, you will need to make a motion to continue the imposition of the automatic stay.

It is unlikely that you credit will be good enough one year after bankruptcy to qualify for a mortgage. Hardship would not be relevant, the mortgage company is going to look at your employment history, credit score and down payment.

If you filed for bankruptcy after having the surgery, did you list the surgical center as a creditor in your bankruptcy paperwork? If you filed for bankruptcy and had the surgery later, those expenses are probably not covered by your bankruptcy and they can still collect from you. However, you should contact the bankruptcy attorney that filed your chapter 13 and explain your situation. Depending on how your chapter 13 is currently set up, you may be able to get a modification to your repayment plan in order to free up some funds to pay the extra $200.
