The funds in the account will be potentially available to the bankruptcy court to satisfy your creditors, see an attorney before you make a move.

Does the bankrupty on a home include the equity loan?

Answered by attorney Roger J Bus (Unclaimed Profile)
Bankruptcy lawyer at Debt Relief Law Center
If you file a Chapter 7 and keep the house, the home equity loan will not be discharged. It will be discharged if you reject the house. If you file Chapter 13, the second mortgage can be discharged if there is no equity in the house over and above the amount owing on the first mortgage.

If I sold a business and the new owners are not paying the debit and because I have a personal guarantee I'm being sued, what can I do?

Answered by attorney Daniel A. Edelman
Bankruptcy lawyer at Edelman, Combs, Latturner & Goodwin, LLC
File suit against them. Depending on the relationship between what you guaranteed and what they agreed to pay, it may be possible to join them in the same lawsuit as third party defendants. For example, if they agreed to pay the debts of the business, you can third party them.
