Will filing bankruptcy prevent me from losing my home?

No way to tell given this limited information. I would be much more concerned with the IRS issue than with losing your home & would suggest that you see a Chapter 13 tax specialist for advice before anyone else. In many instances, IRS debt can be discharged or paid off at a reduced rate in Chapter 13.

Can I proceed to change jobs or do I have to wait if I file for chapter 7 because of a drastic decrease in pay and the inability to pay my debts?

If you change jobs after filing a Chapter 7 bankruptcy, no one is likely to care. Bankruptcy law measures you eligibility based on your earnings at the time you filed.

If my Ch 13 gets dismissed can I immediately file another Ch 13?

default-avatar
Answered by attorney Ronald Karl Nims (Unclaimed Profile)
Bankruptcy lawyer at Ronald K. Nims
If dismiss your Chapter 13, you can immediately file another Chapter 13 but you need to do a thorough analysis of the numbers to determine if it would help you. This Chapter 13 was blown up by a large priority claim for state taxes, an increase in your personal expenses for health insurance and a decrease in household income from your wife's layoff; all those factors will still be present in your new Chapter 13. The first thing you need to do is determine if the state's tax claim is legitimate. State tax departments are notorious for filing unsubstantiated bankruptcy claims.
