How much debt is required to file bankruptcy?

Answered by attorney Philip Rory Boardman (Unclaimed Profile)
Bankruptcy lawyer at Haven Law Group, P.C.
There is no limit. It really comes down to a practical decision on your part of whether you can take care of the debt on your own or if you need to file a bankruptcy.

Of course you must have listed the second mortgage as one of your debts in the bankruptcy. It will be discharged also.

Can I convert from chapter 13 to chapter 7 bankruptcy?

default-avatar
Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
You can convert if you can qualify to do so. There are many factors that will need to be considered to see if you will qualify for Chapter 7 and you wouldnt want to jump from the frying pan into the fire. You will also want to understand that whatever goals you had in your Chapter 13 (such as lienstripping, catching up on a mortgage loan, paying off your car, paying off the IRS) may end if you convert. Best regards,
