Do I need to file bankruptcy if collectors are calling me and I cannot pay what I owe?

Typically collection companies will start with harassing phone calls, threatening letters, and eventually file a lawsuit against you. Unless you can arrange some kind of settlement with them or otherwise defend yourself from their lawsuits- they will eventually start to garnish your wages, seize bank accounts, etc. Bankruptcy can be a way for you to stop debt collectors in their tracks and keep your money and property from their grasp. Your best bet is to call a bankruptcy attorney and find out what your options are.

Can anything be done if the debtor files bankruptcy but the creditor was not notified?

Answered by attorney Kenneth Love (Unclaimed Profile)

You need to speak to an attorney and go over all of the facts. Unfortunately, your debt is likely discharged even without notice. You can move to have the case reopened but unless you have an exception to the discharge, there is not much you can do. In your contract, you should have hopefully retained the right to retake the business if a bankruptcy is filed. Your contract, as your described it, sought to declare all amounts due if they file bankruptcy...the problem is Bankruptcy then potentially wipes it out.

What would normal attorney fees be for handling a chapter 7 bankruptcy?

Answered by attorney Kathryn Ursula Tokarska (Unclaimed Profile)

By normal I suppose you mean typical. Obviously nobody knows what every single lawyer out there charges but $1,500 is a generally understood to be a mid range price thrown out there. Legal fees depend on what is involved in the case. Some cases require more work than others, hence a difference in fees from one case to another. Unpaid legal fees are debt and so dischargeable in the bankruptcy itself hence attorney will want to be paid upfront before the case is filed and not become a creditor in your bankruptcy case. Payment by check or cash is normal.
