You cannot get a Discharge if you received a Discharge in the 2007 case. A Discharge is not available for 8 years from the filing of the first case.

If someone pays the back taxes and penalties of a property to the town, do they now own the property.

If the property is foreclosed upon for failure to pay taxes, and it is purchased at auction, then the purchaser takes the property, but subject to any other liens or interests. So if there is a mortgage on the property, home equity loan, etc. it goes with the property. If there is no foreclosure sale and you just pay the taxes, it is a gift, unless you have some other agreement, in writing with the property owner.

I would not recommend filing bankruptcy on this small amount of debt but I would attempt to work out a settlement plan before your court date. If you cannot reach one then you will need to appear and present the facts to the judge and see what judgment is entered. If you have other debts however you may want to speak with a bankruptcy attorney to see what options are available.
