What is the best way to protect my property if I file for chapter 13 bankruptcy?

Chapter 13 is a payment plan that does not entail liquidation, but the measure of one's assets can determine the threshold for payment in the plan, so excessive assets can make a chapter 13 unfeasible. Can't have cake and eat it. As far as the allusion to quit-claiming, that constitutes fraud under these circumstances. This answer (as well as our Web site) doesn't address all facts & implications of the question; it's general info, not legal advice to be relied upon; it creates no attorney-client relationship; it may be pertinent to CA only; it's independent of other answers. Hire legal counsel before acting or refraining from bankruptcy/legal action.

Should I file some type of bankruptcy or not ?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
If the reverse mortgage is the only debt against your home and it is really worth $800,000, you have more equity than you can protect in a Chapter 7 case, and would have to provide for close to a 100% repayment of the debt in a Chapter 13 case and that would require a payment of close to $1,000 per month which you probably cannot afford. The good news is your creditors can't take your SS benefits, so they would be left with putting a lien against your home (or trying to sell one of your cars, but that's highly unlikely).  Unless you plan on selling your home or refinancing, that won't really affect you until that time (at which time they would get paid from the sale, although plus accrued interest). You should probably have a consultation with a bankruptcy attorney in your area to go through things in more detail, but it sounds like doing nothing is an option for the time being.

Will we be able to stay in the home and make voluntary payments on the mortgage even though we are so far behind?

Richard B. Jacobson

You have a lawyer, so why are you asking this site for information which he or she is paid to provide you? That said, the creditor can ask the Court for Relief from Stay, or just wait 90 days or so until the discharge, to proceed with the foreclosure. If you could afford it, you could do a Ch. 13 in which you catch up on the arrearage over 60 months, and also resume making the regular scheduled payments. That can be very harsh on your cash flow. Or you can try to negotiate something with the creditor. That is not frequently successful, but it seems worth a try.
