There is little to do if your lender refuses to foreclose. Send a letter by certified mail describing the situation whereby you do not want to keep the property. Let them know they are jeopardizing the condition of the house in that you no longer reside there. Request a written response.

The mortgage is "current" as long as you have paid on it. If you did not then you are delinquent and the lender has a right to foreclose.

I have never seen a debtor's attorney file a Reaffirmation Agreement. It is always filed by the creditor. The good news is that you can still rebuild your credit through other new creditors, just not this bank. You do not owe the bank any money, so you could walk away from the house at any time and would not be responsible for any shortfall, but the bank still could foreclose if you stop paying.
