Should I file for bankruptcy if I am unable to live on my salary after paying my loans?

default-avatar
Answered by attorney Kathryn Ursula Tokarska (Unclaimed Profile)
Bankruptcy lawyer at Law Offices of Kathryn Tokarska
Please understand that we cannot provide legal advice over the internet. Whether to file bankruptcy and when is a question that would involve providing legal advice. There are various facts to consider in determining whether to file and when. You'll want to confidentially discuss your financial situation. The attorney will want to know your "current monthly income", the types and values of all of your assets, types and amounts of debts, recent activity between you and the creditors, age of the defaulted debt, size of your household, your reasonable and necessary living expenses. Answers to these and other questions go toward determining what you hope to accomplish through the bankruptcy and whether this is feasible.

What are my rights if I have never received anything in the mail from them and signed no contract?

Answered by attorney Daniel A. Edelman
Bankruptcy lawyer at Edelman, Combs, Latturner & Goodwin, LLC
The problem is that if there is an underlying debt that is a contract and you may be in breach of that. You should not enter into agreements with debt collectors that are not clearly documented. You should have an attorney review the facts to determine whether there is a violation of the Fair Debt Collection Practices Act or other law. It is not unknown for debt collectors to agree to settle on some set of terms and then claim that you did not make payments on time or otherwise violated the deal, so they don't have to honor it.

Can I file bankruptcy for the second time if my first filing happened in 2005?

Laura J Gabel
Answered by attorney Laura J Gabel (Unclaimed Profile)
Bankruptcy lawyer at Gabel, Gudmundsen & Gabel, P.C.
It all depends on the chapter of the bankruptcy code you proceeded under in 2005 and what chapter you intend to use now. There are basically two chapters available to consumer debtors: Chapter 7 and Chapter 13. There has to be two years between a Chapter 13 filing followed by another 13 filing. There has to be four years between a Chapter 7 followed by a Chapter 13; six years between a Chapter 13 followed by a Chapter 7; and 8 years between two chapter 7 filings.
