Can I sell my house and pay my debts even if my voluntary bankruptcy is not signed?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
If the case was dismissed, then the bankruptcy court has no jurisdiction. You can transfer title as you normally would in your state, subject to the same rules in your state.

When can I declare bankruptcy again after filing eight years ago?

Answered by attorney Gregory J Wald (Unclaimed Profile)
Bankruptcy lawyer at Gregory J. Wald
It depends on whether you filed a chapter 7 or a chapter 13 last time and what type of bankruptcy you want to file this time. However, the waiting period between two chapter 7 cases is 8 years, measured from filing date to filing date.

How much debt do you have to currently be in to file for bankruptcy?

Answered by attorney Austin M Hirschhorn (Unclaimed Profile)
Bankruptcy lawyer at Austin Hirschhorn, P.C.
There is no debt limit in Chapter 7 or 11. There is a debt limit in Chapter 13. When you meet with the lawyer that is going to file your case, one of the things that must be done by the lawyer is to review the various chapters of the bankruptcy code with you. I am sure you will be filled in on the filing limits if the lawyer you select has familiarity with the Bankruptcy Code and Rules. Under the rules of professional conduct a lawyer should not undertake representation of a client in an area of law that the lawyer is not familiar with.
