What can be done on a motion to abandon real estate property?

Answered by attorney Ronald K. Nims (Unclaimed Profile)
Bankruptcy lawyer at Ronald K. Nims
There is no specified amount of time for the trustee to abandon property. The property should be abandoned if the property is a burden or if there is no equity. So if the property is free and clear of any mortgage and the trustee can be reasonably expected to get some funds from the sale - even $1,000 then the court is unlikely to compel the trustee to abandon the property.

How much debt do you have to currently be in to file for bankruptcy?

Jeremy B Shephard
Answered by attorney Jeremy B Shephard (Unclaimed Profile)
Bankruptcy lawyer at David Andersen & Associates, PC
There is no limit but you want to consider the implication of filing bankruptcy (bad credit score, future ability to get credit, etc). The lower the amount the less likely bankruptcy makes sense; however, everyone's situation is different.

Can trustee take my guns if I have a chapter 7 and what are the exemptions to keep my guns?

Your trustee didn't mention you could move things around legally to protect property because there is no such thing. Moving things to defraud your creditors is bankruptcy fraud and the penalties are severe, possibly even prison. In Ohio, guns owned for personal use are exempt up to $525 per gun. As long as you aren't in business buying and selling guns most personal weapons fall under the exemption.
