Can I file bankruptcy on my mother's credit card bills? How?

default-avatar
Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
You cannot include someone elses debts in your bankruptcy. Even if you are a co-signer on the account, your bankruptcy will only discharge the debt as to you, and will not eliminate the debt as to your mother. Depending on the circumstances, your mother may not need to file bankruptcy in order to avoid paying the credit card debts. More information would be useful.

Will my house go in foreclosure if I convert from a chapter 13 to 7?

If you are still significantly in arrears on your mortgage (4 payments or more), then yes, your mortgagee could certainly proceed to foreclosure.

How can my daughter make her husband pay his share of the bills?

Bankruptcy does allow people an opportunity to walk away from their debts. Whether the divorce will protect your daughter from the consequences of this bankruptcy will depend on how the judge worded the decision. In any event, unless you want to face legal consequences, do not go and pick up the appliances. An attorney experienced in both bankruptcy and divorce will need to review the exact terms of the divorce to properly advise your daughter about her legal rights.
