Until the house is foreclosed on and sold, the property remains in your name. You are responsible for the taxes, insurance, and any violations that are levied against it. Contact the lender and offer to sign the property over via a deed in lieu of foreclosure. There are some additional requirements, but it may be the best choice.

You don't really get to choose which type filing to make; rather, it depends upon your income and expenses. Of course, a chapter 7 is more quickly resolved and gets you moving forward with re-establishing your credit sooner for purposes of purchasing a home.

When they count your income do they count after expenses, mileage, business expenses and all that?

The income for the means test is based on gross income; however, you are allowed to deduct items from that amount in determining eligibility. I highly recommend you retain an attorney to help you do this analysis as it is a bit complex.
