Question: Why are we still on the title if we surrendered the house in bankruptcy? Question Detail: We are being sued by the HOA but we did not just declare bankruptcy. We surrendered the house. Why does this not protect us against the HOA? The judge even confirmed the fact in bankruptcy court that we have surrendered the house. *- you should check with your lawyer regarding that; was the HOA named as a creditor in the bankruptcy petition?*

Student loans are largely non-dischargeable. So, you might want to rethink this. There is no minimum for filing a chapter 7 bankruptcy, but you can only do it once every 7 years or so. It will be on your credit report for around 10 years. You have to look at the overall financial picture to determine what the best thing to do is. It might help you to contact a consumer credit counseling agency, rather than to file bankruptcy. Sometimes, and especially with low debt like yours, they can help.

To determine this, check the US Trustee?s website for the Median income in your State and County. That will determine if you can file a Chapter 7 with or without a presumption of abuse. The presumption can be overcome, but it is a good place to start. Also, make an appointment with a Bankruptcy Attorney in your jurisdiction.
