HOA Field Lien

Angelo Anthony Gasparri
Answered by attorney Angelo Anthony Gasparri (Unclaimed Profile)
Bankruptcy lawyer at Gasparri Law Group
As it turns out, no.  There is a problem in the way the HOA lawyers are doing this.  The debt owed to the HOA is always assocaited with the house, but it is not in personum to you --  The lien provides the HOA with the right to collect NOW, which is a violation of your Bankruptcy discharge.  It leaves them without a way to perfect the obligation that runs with the land.   You should consult with your lawyer about filing a motion for sanctions.  We just filed one on behalf of one of our clients.

Is there a way to file bankruptcy and get out of my student loan as well?

default-avatar
Answered by attorney Edward M Olson (Unclaimed Profile)
Bankruptcy lawyer at Olson Law Firm
Sounds like it is time for your parents to step up to the plate and provide you some health insurance. The child support and student loan are non-dischargeable. If the credit card obligations are part of the divorce settlement (and considered spousal support), they may also be non-dischargeable. You should call an attorney to obtain legal advice regarding your specific situation.

Can you remove judgement off your record and credit record?

Answered by attorney Christopher J. Kane
Bankruptcy lawyer at Christopher J. Kane, P.C.
In Oregon a judgment is enforceable for 10 years, and can be renewed by the plaintiff for another 10 years. The credit reporting agencies do not have to remove it from your credit reports while the judgment is enforceable.
