What happens if had chapter 7 discharged in 2010 and now have pending 2014 employment lawsuit after filing chapter 7?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
Your 2010 case should have been discharged by now. The Trustee should have abandoned the suit, if it was in existence at the time of your 2010 filing. If it was not in existence at the time of your 2010 filing, then there is clearly no issue as it would not have been part of your estate.

Is it legal to sell a property that has a lien?

default-avatar
Answered by attorney Margaret L. Evans (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Margaret L. Evans, PC
The lien simply means that the debt is secured by the mobile home; if you don't pay as promised on the mobile home loan, they have the legal right to repossess the mobile home and assess any deficiency, plus attorney's fees, that they incur as a result of a judicial sale. You can certainly sell the mobile home with the lien on it, however, that lien must be satisfied with the sale proceeds, otherwise the lender won't release their lien on the mobile home title.

Can we be sued after filing bankruptcy on our old house?

Answered by attorney Dustin Douglass Deissner
Bankruptcy lawyer at Deissner Law Office, P.C.
Anything you owed them for the house as of the date of filing was discharged in Bankruptcy unless something went wrong which is possible. Send them a copy of the Bankruptcy discharge paper you received. If that doesn't work contact whoever handled your bankruptcy.
