Talk with your attorney who drafted the chapter 13 plan that you fixed your signature upon. It will clearly state how and where the home equity debt is to be paid. I provide all my clients with a copy and explanation of their chapter 13 plan

Can back income taxes be included in a bankruptcy?

Answered by attorney Marjorie A. Guymon

Yes, they must be included. However, they may be non-dis-chargeable. You need to have your tax transcript pulled and analyzed before you file.

Do I need to report to the court that we already received the inherited money before cashing them out?

Of course you must report this money to the bankruptcy trustee unless the trustee abandoned this asset. Do not spend the money without permission from the trustee because to do so would be a theft offense.
