You can only file for a Chapter 7 (complete discharge) once every 8 years. If your prior bankruptcy was a Chapter 7, and it has not been 8 years, you may be able to file under a different section (for example, a Chapter 13 reorganization/repayment plan).

If you are unable to pay, and the car is repossessed, and the bank gets a lifting of the automatic stay, and they get a deficiency judment against you, it will be good for 20 years if they record it properly. You see there are many things that your attorney can help you with, on this one issue.
