Can I cancel the chapter 7 that was filed three weeks and then re-file later?

Answered by attorney Carl C Silver (Unclaimed Profile)
Bankruptcy lawyer at Carl C. Silver Attorney at Law
No. As a general rule you cannot cancel, withdraw, or dismiss your chapter 7 unless you can prove to the Judge that your creditors will receive more money if your case is dismissed which is usually quite difficult to do.

How many times can a bank charge NSF fees on a returned check?

Answered by attorney Daniel A. Edelman
Bankruptcy lawyer at Edelman, Combs, Latturner & Goodwin, LLC
This is a question which cannot be resolved except by analysis of the facts, including (a) reason for account being overdrawn, (b) whether debit or check transactions are involved, (c) what account agreement says, (d) nature of charter of financial institution (federally-chartered institutions have preemption defenses that state chartered ones do not), and (e) whether the institution is reordering items to increase overdraft fees. You need to present the facts to an attorney.
