I file chapter 13 once, how many years do I have to wait to file bankruptcy again?

Answered by attorney Edward C. Hay
Bankruptcy lawyer at Pitts, Hay Hugenschmidt, PA
You can file another 13 now. If you paid at least 70% of the claims in the first case, you can file a 7 now, otherwise the waiting period is 6 years from the date of the filing of the first case.

Do I need to amend the petition if I changed my mind in keeping the house?

Susan Green Taylor

Consult your attorney about reaffirmation. If you haven't formally reaffirmed with the mortgagee, you can walk away anytime, during or after your case has concluded.

Can I exclude an unsecured loan from my petition?

Answered by attorney Ronald Karl Nims (Unclaimed Profile)
Bankruptcy lawyer at Ronald K. Nims
When you file bankruptcy, you're required to list all your assets and all your debts. You'll swear (or affirm) to this on penalty of perjury. So, you have to list all your debts, even cosigned debts. And you're obligation on the debt will be discharged while your father will remain liable. You can ask the court to reinstate your liability, this is called "reaffirmation". However, even if you're not liable, you can still make the payments.
