Ultimately, the answer can only be arrived at by consulting a qualified bankruptcy attorney. Unfortunately, since some bankruptcy filings are rather straightforward, inexperienced attorneys, and worse, non-attorneys offer to prepare your petition without giving much thought to all the factors that impact your case. For their self-interest, they tend to direct you into filing in a way and/or a chapter with which they are familiar instead of the correct chapter. Don't be fooled. Reputable bankruptcy attorneys command hourly rates higher than most attorneys, except perhaps full-service tax attorneys, for a reason bankruptcy law is complex and if you do not prepare a case properly, the debtor can get into more trouble than when the case started because a bankruptcy has many procedural and substantive minefields which sometimes you can only avoid with the guidance of a knowledgeable practitioner. Nevertheless, a bankruptcy case will feel simple to the debtor if it is prepared properly, anticipating issues based on the debtor's specific state of affairs or waiting to file until circumstances are more favorable (such as at a time when a tax debt can also be discharged) or sometimes advising the client not to file. If either of you are authorized signers on the others credit card it is likely they could enforce the debt against both. Otherwise they could have trouble.. However to the extent you have separate assets they could enforce the debt against the assets.
