If I filed for bankruptcy October 18, 2012 and if the case closes before I file taxes can the trustee take my tax return?

It doesn't matter when your case closes or when you file the tax return or receive the tax refund check. If the tax refund money isn't exempt, it isn't yours, it belongs to your creditors and you must give it to your trustee to distribute. If you try to keep it, the trustee will find out and will revoke your discharge, making it impossible for you to ever discharge the debts you listed in any other bankruptcy. Don't make the mistake of thinking that the Trustee will forget about it & that you won't get caught because the IRS provides all information about your taxes to the trustee's office.

You do not provide much information, but if you lost your license due to an unpaid judgment arising out of a motor vehicle accident, discharging the underlying judgment debt in bankruptcy will result in your operating privileges being reinstated. As soon as the bankruptcy is filed the automatic stay provisions will result in your license suspension being lifted.

If a creditor has a judgment it can levy on bank accounts in the judgment debtor's name. If an account should not have the debtor's name the name should be removed. You might want to have the account order show proof that it is not the debtor's money. You could sue in small claims court based on that.
