It is rarely advantageous for consumers to use for-profit debt settlement companies. There are many complaints that they took money from consumers, applied it to fees, and did not settle the debts. Try non-profit consumer credit counseling services instead. You should revoke the power of attorney and appear and defend the lawsuit. Make certain you comply with all deadlines. Generally, if the lawsuit is brought by a debt buyer, they cannot prove anything (including their ownership of the debt, the amount, etc.) and you should resist the lawsuit. If it is an original creditor likely to be able to produce a witness (e.g., a bank with local offices) you should try to settle.

In Chapter 7, generally the car will not be repossessed. In most cases, you simply need to make the payments, keep up with the insurance, and sign the reaffirmation agreement. Talk to a lawyer about your situation.

That kind of provision is unenforceable. It's used to scare consumers. You might try crossing it out, initialling the cross-out, and pointing out the change you have made to the sales person in writing. I cannot say for sure, but I speculate they would sell you the car anyway. Good Luck.
