If it was truly discharged that is a violation fo the automatic stay and you can go to BK court to sanction them.  YOu need to be careful though because many types of debt owed to the State of Florida would be Non-Dischargeable priority debt.     YOU WILL NEED TO CONSULT A LAWYER to analyze the obligation and why it is not being considered discharged, as well as if you have the right to pursue sanctions.

No, if the debt is not in his name he cannot discharge the debt. Furthermore, a court order by a family law judge cannot be overturned by a bankruptcy filing. It will still stand. For example, John has a court order divorce agreement that he needs to pay for his ex-wife's car loan that is in the name of his ex-wife AND himself. John files bankruptcy and discharges the car loan debt as to his own liability. He feels he should not have to pay anymore since he is not driving the car and he filed bankruptcy. He would still have to pay for the car since the debt is still in his ex-wife's name and the court order still exists.

No, you can add in additional creditors to your bankruptcy at anytime until it closes, provided that the debt was made before you filed Chapter 13. The court charges a $30 filing fee to do this and expect your attorney to add on a charge for the additional work as well. By the way, it isn't enough to just add the additional creditor with an amendment. You also have to make sure the creditor is served with the notices that the court sent to all of the initial creditors, including a copy of the plan and a form to file a proof of claim.
