Is there a statue of limitation in California for credit card debt?

default-avatar
Answered by attorney Sanaz Sarah Bereliani (Unclaimed Profile)
Bankruptcy lawyer at Bereliani Law Firm, PC
Judgments/collections can be done upto 10 years and can be renewed ever 10 years. If your name is on an account that gives them enough of an excuse to withdraw money from the account, whether you put the money in the account or didn't. It's assumed you have an interest in the account. There are different statute of limitations for different debt/different injuries/etc.

Will I still have a judgment after bankruptcy?

Sally J Elkington
Answered by attorney Sally J Elkington (Unclaimed Profile)
Bankruptcy lawyer at Elkington Law
The amount of the Judgment should be discharged in your bankruptcy. As long as the judgment is not a lien, you should not have to do anything further, but file a bankruptcy.
