If am disabled will my husband be responsible for taxes?

First of all, no one is ever personally responsible for real estate taxes. The County Treasurer will look toward the land/house to eventually receive payment on the taxes. Some one will have to pay enough of the back taxes to avoid the property being sold at tax sale. If you filed Bankruptcy in 2007, most likely your personal obligation on the mortgage note should have been discharged. Therefore the bank can only look toward the house to get any money. Do not walk away. Do not do a short sale and do not "give" the house to the bank. Let the bank foreclose on the house. By the time they send you notice of default letters, do the publication in the newspaper, (or file complaint in court for foreclosure), and wait through your 6 month redemption period you will probably end up living there for about 1 year before you have to move. Why would you want to give up this much rent or payment free living?

Your question is over complex for this forum. I would suggest you see an attorney, preferably one for Melanie with bankruptcy law.

You do not give enough facts. Someone has to pay the taxes. Being 2K under the fmv is not that underwater to walk away.
