Will my future husband's income be considered when I file for bankruptcy?

Answered by attorney Nicholas Belisle Lazzarini
Bankruptcy lawyer at Young & Lazzarini
If you plan on filing for Bankruptcy before getting married, and your future spouse has noticeable assets or income, it may be advantageous to wait until you are granted a discharge before getting remarried. This will avoid any possible complications regarding the additional assets or income being included in your petition.

Can we keep our cars if we file bankruptcy?

Answered by attorney George Hoselton (Unclaimed Profile)
Bankruptcy lawyer at George Hoselton Bankruptcy
A chapter 7 bankruptcy allows you to keep vehicles, but there are limits to the amount of equity you can have in each vehicle. These limits also known as exemptions vary from state to state. A chapter 13 also allows you to keep vehicles and the exemptions are deducted from any equity in the vehicles, reducing how much has to be paid to the trustee. Payments for the vehicles should be within your budget. There is no guarantee that a judge or your attorney will sign off on a reaffirmation if the payments for the vehicles are not within your budget. You should contact an attorney in your state to confirm whether or not you can keep your vehicles.

Can I sign a land contract to a home that is more in the range to what I can afford?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Bankruptcy lawyer at Richard B. Jacobson Associates, LLC
I can't see why not. But if you contract a new loan while you are in bankruptcy, you will likely need the court's permission. Consult an experienced bankruptcy lawyer to advise and represent you. It's almost always worth it. Good Luck.
