How likely will I be forced to file for a chapter 13 bankruptcy?

Answered by attorney Jeffrey M. Cook (Unclaimed Profile)
Bankruptcy lawyer at J.M. Cook, P.A.
That is impossible to predict and I would usually rely on the local atty. If you are not sure, get a second opinion from a competent bankruptcy professional.

Does a confirmed Chapter 13 stop any creditor on the petition from filing a complaint for fraud for the same debt with the Department of Insurance?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
Bankruptcy does not prevent a creditor from filing a criminal complaint against a debtor. Bankruptcy only deals with the discharge of civil debt, not criminal offenses. See 11 USC sec 523 for further information about the relationship between bankruptcy and the criminal justice system.

Write your lawyer a letter, keep a copy, to protect yourself. He should act on the letter and you have proof you disclosed. Best of luck.
